Together, the National Law and the National Regulations set the National Quality Standard and provide a regulatory framework for education and care services in Australia. This includes most long day care and family day care services and preschools/kindergartens and outside school hours care services.
Approved providers and educators working directly with children should familiarise themselves with the National Law and the National Regulations, and understand how the requirements apply to their role.
The National Law provides for a jointly governed, uniform, national approach to the regulation and quality assessment of education and care services.
The National Law was developed cooperatively by the Australian Government and states and territories through the process of national applied laws legislation.
The Education and Care Services National Law 2010 was passed by Victoria and adopted by other states and territories, except in Western Australia where corresponding legislation was passed.

The National Regulations set a range of operational requirements for education and care services in Australia. They outline the assessment and rating process. They also set out the requirements for preparation and review of the QIP, the different rating levels that may be given to a service, the process for completing assessments and determining a rating, and the process for review of ratings.
