Content means content on the ECRH.
Early Childhood Resource Hub or ECRH is the Early Childhood Resource Hub, but does not include websites to which the ECRH has links.
ESA means Education Services Australia Limited.
Registered User is an individual who has registered online to have access to the ECRH forums and to receive the ECRH newsletter.
Unless indicated otherwise, all intellectual property rights subsisting in the Content and the ECRH are owned by the Commonwealth of Australia. For the avoidance of doubt, no legal relationship is created between the Commonwealth of Australia and a Registered User or any other ECRH user.
ESA presents the Content in good faith and has endeavoured to ensure that all Content is accurate and does not breach any entity's rights at the time of its inclusion. However, the Content may contain unintentional errors and is provided 'as is'.
Where Content is indicated as being offered under a Creative Commons licence, you may use that Content in accordance with the relevant Creative Commons licence. Where Content is not offered under a Creative Commons licence, you may use, reproduce and communicate that Content free of charge for non-commercial educational purposes, provided all acknowledgements are retained.

ESA provides links to Non-ESA Sites which, at the time of linking, were of educational value. However, as content on Non-ESA Sites is not controlled by ESA, such content may change over time. If you discover that the content on a Non-ESA Site is unexpected or inappropriate for an education audience please contact email@example.com as soon as possible.
You agree to keep your Registered User password for the ECRH secret and confidential. If you have reason to believe that your password is no longer secure (for example, if it has been lost or stolen), you must immediately reset your password via the forgotten password page.
All posts which you make to the ECRH forum and for which you own the copyright will be made available to other users in accordance with a Creative Commons Attribution Licence. This licence allows anyone to copy, distribute, transmit, and adapt your post royalty-free and even commercially, provided they attribute your authorship each time they do any of those things. Only Registered Users may post to the ECRH forum. If you want to post to the ECRH forum you must sign off the post with your first name. If you do not want to provide your first name, you will be able to read the ECRH forum but not create or reply to posts. If a post is not signed off with your first name, the post may be removed by ESA. Your forum alias must be unique and must not be illegal, obscene, defamatory, or threatening.

You (and only you) are responsible for all posts made, and the consequences of posting, to the ECRH forum. Neither ESA nor the Commonwealth of Australia is responsible or liable for your posts to the ECRH forum.
ESA will not be liable, under any circumstances and in any way, for any errors or omissions or loss or damage of any kind incurred as a result of use of any content posted on the ECRH forum. You must evaluate and bear all risks associated with the use of any post, including any reliance on the accuracy, completeness, or usefulness of such post.
'Personal information' means any information or opinion about you from which your identity is apparent or can be reasonably established.
ESA respects the privacy of individuals, protects personal information and complies with relevant Australian privacy laws. ESA will only collect your personal information if you become a Registered User. ESA will use your personal information only for the purpose/s for which it has been collected (if at all). The purpose includes providing some ECRH services, for example, the ECRH forum.
ESA takes reasonable steps to protect the personal information that it holds from misuse, unauthorised access, modification or disclosure. If you become a Registered User, the personal information that ESA may collect is your first and last name, your email address, and the name of your service/organisation. When becoming a Registered User you can opt-in to receive electronic communication (e-Bulletins) from the ECRH.
If you believe that the personal information that ESA holds about you is incorrect, please contact ESA at firstname.lastname@example.org and ESA will take reasonable steps to amend that information.
Whilst ESA has made reasonable efforts to ensure that all Content available through the ECRH is educationally sound at the time of publishing the ECRH, ESA does not make any representation or warranty about the accuracy, reliability, currency or completeness of any Content.
In some cases the Content on the ECRH may incorporate or summarise views, standards or recommendations of third parties or comprise material owned, developed, or contributed by third parties ('third-party material'). Third-party material is presented in good faith, but does not necessarily reflect the considered views of ESA, or indicate a commitment to a particular course of action. ESA makes no representation or warranty about the accuracy, reliability, currency or completeness of any third-party material. The presence of third party material on the ECRH in no way creates any legal relationship between the third party and a Registered User or any other ECRH user.
The ECRH is provided to you on an 'as is' and 'as available' basis and you use it at your own risk. To the extent lawful, ESA makes no representation or warranty (promise) as to the suitability or compatibility of the ECRH to any computer system, or that the ECRH is free of error, defect, virus or other harmful element or fit for the purpose you intend to use it. Neither ESA nor the Commonwealth of Australia will be responsible for any loss, damage, liability or expense suffered by you or anyone else arising from your use of, or inability to use, the ECRH.
